Privacy Policy
Preamble
We respect and protect the privacy and security of users of our websites (“Users”).
This Privacy Policy (“Privacy Policy”) applies to data submitted to us via the website operated at befard.pl (“Service”). In this Privacy Policy we describe which information we collect in connection with our provision of services (“Services” or “Service”), and for what purposes and how it is used.
The term “data processing” used in this Privacy Policy concerns information voluntarily provided by Users as well as information gathered automatically (via so-called “cookies”), and covers all operations on personal data, in particular collection, recording, storage, processing, modification, disclosure and deletion, carried out in connection with the provision of the Service and Services.
The primary aim of data processing is to consistently improve the Service and the Services so that Users can use them in the simplest and most efficient way.
- 1. Data administration
The administrator of the personal data of Users who are natural persons is BEFARD Spółka Z Ograniczoną Odpowiedzialnością, with registered office in Kozy (43-340), ul. Pod Grapą 4, NIP: 5472152636, REGON: 360523489 (hereinafter: “BEFARD”). BEFARD processes personal data of Users who are natural persons in accordance with data protection laws, in their versions resulting from current acts, and in accordance with other generally binding legal acts.
Personal data are provided by Users completing interactive forms placed on the Service. A User is not obliged to provide their personal data. However, refusal by a User to provide or share data necessary for the provision of the Services results in a justified inability by BEFARD to provide the Service, and may restrict the User’s access to the Service or its individual functionalities.
BEFARD primarily processes personal data of Users for the purpose of properly providing the Service, as well as for the direct marketing of its own products and services or on the basis of the legitimate interest of the data controller. BEFARD processes personal data in the following scope: first name and surname or company name, telephone number, e-mail address, URL of the website, and any personal data provided by the Users themselves in sent e-mails, as well as the data listed in § 4 item 1.
The personal data referred to in item 3 above may be entrusted for processing to IT service providers, accounting and settlement service providers, or other providers operating under an order from BEFARD, solely for the purpose of providing services to BEFARD.
BEFARD ensures that Users can exercise the rights provided by the personal data protection laws, including the right of: access to their data and correction thereof, rectification, deletion, restriction of processing, provision, transfer, and objection to their processing; the withdrawal of a consent to personal data processing at any time, provided that withdrawal does not affect the lawfulness of processing which was carried out on the basis of a consent before its withdrawal; lodging a complaint with the supervisory authority responsible for personal data protection in case the processing of personal data violates the provisions of the General Data Protection Regulation of 27 April 2016.

Personal data will be stored only for the period necessary to provide the Services to the Users.
- 2. Data security
Registration and authorization processes of the User are handled by means of a secure SSL protocol.
Access to personal data is granted only to trained and authorized employees of BEFARD.
- 3. Data recipients
Data collected and processed by BEFARD may be disclosed to third parties in accordance with the Privacy Policy and applicable laws, if it is deemed necessary for:
- protection of the rights of BEFARD or third parties;
- protection of public security or other persons;
- prevention or stopping of unethical or offensive acts;
and in any other cases required by law, especially in case of suspected crime or infringement of intellectual or industrial property rights.
Subject to the proviso in paragraph 1 of this clause, we do not pass on, sell or otherwise make available the personal data of Users to other persons or institutions unless the User has given explicit consent.
We reserve the right to disclose to our cooperating companies and websites aggregated, general statistical summaries concerning Users.
- 4. Technical matters, deletion, data retention
During browsing of the Service our servers automatically collect information sent by the browser and contained in system logs. This information may include various data, in particular the e-mail address, IP address, type of browser, the website visited immediately prior to entering our Service, time of entry into the Service, and other statistical data, and may be used by BEFARD for concluding, changing, terminating a contract with the User, ensuring the highest quality of the Services provided, and also for technical and statistical purposes.
As a rule, BEFARD will cease processing a User’s personal data after the User has stopped using the Service. After termination of the Service, BEFARD may process data:
a) necessary to settle the Service and to pursue claims for payment for the use of the Service;
b) anonymised data necessary for purposes of advertising, market research and behaviour and preference studies of Users for the purpose of improving the quality of services provided by BEFARD, with the User’s consent;
c) data necessary to clarify the circumstances of unauthorised use of the Service.
In the event that BEFARD obtains information about a User using the Service contrary to the regulations or applicable law (unauthorized use of the Service), BEFARD may process the User’s personal data to the extent necessary to determine the User’s liability, provided that it will record for evidential purposes the fact of receipt and content of that information.
BEFARD may notify the User of their unauthorized actions with a demand to cease immediately, and may also exercise the right mentioned in paragraphs 2 and 3 of this clause.
- 6. Cookies
BEFARD uses text files “cookies”. A “cookie” is a small piece of information placed at the request of our server (“first-party cookies”) on the telecom device (for example a computer, smartphone, etc.) of the User during a visit to the Service, which the server can read when reconnecting from that device. The use of cookies is intended to ensure correct functioning of the Service on the User’s telecom devices; this mechanism does not cause configuration changes in the User’s device or software installed on that device.
BEFARD uses the following kinds of files cookies:
- session cookies – stored on the User’s telecom device only for the duration of visiting the website of the Service, closing the browser or logging out of the Service; and
- persistent cookies – stored on the User’s telecom device for a specified time or until they are deleted by the User.
BEFARD uses the cookie mechanism for the purposes of:
- facilitating navigation on the pages of the Service, including preserving the User’s session so that there is no need to log in again on each subpage;
- verification and development of our offer, including adapting the Service content to the preferences of the User; as well as
- statistics.
By using the Service, the User may receive cookies from third parties cooperating with BEFARD such as: Google Analytics, Google Ads, Google DoubleClick, HotJar – services that help us assess how the site is used, analyse conversions and deliver user-tailored advertisements; Facebook, YouTube – social network plug-ins integrated with the Service.
The User may specify the conditions for cookies via their web browser settings. In particular, every User may disable the cookie mechanism in the browser of their telecom device. BEFARD points out that disabling the mechanism may, however, cause difficulties or make it impossible to use the Service.
- 7. Commercial information
BEFARD reserves the right to send Users who have signed up for a newsletter commercial information about BEFARD’s operations and the operations of BEFARD’s partners and contractors.
Each recipient of the newsletter has the right to object to receiving commercial information from BEFARD by clicking the “unsubscribe” link.
- 8. Minors
The Service is intended for persons of full legal age.
Persons who have not attained the age of eighteen may use the Service and the Service-Offer only with the knowledge and consent of their legal representatives. Persons under age are asked not to provide us or other Users any information via or in connection with the Service, in particular personal data.
- 9. Links
The Service may contain links which redirect the User to an external website. The existence of such links cannot be equated with any kind of relationship between BEFARD and the entity to which the external website belongs.
BEFARD in no event accepts liability for the consequences of such redirections, has no influence on the content of the external websites, accepts no liability for the privacy policy and security policy in force on those sites, nor for the cookies used during their browsing. We encourage Users using such links to read the relevant documents applicable on those sites.
§ 10. Final provisions
By using our Service you consent to the provisions contained in the Privacy Policy.
